Hosting Terms & Conditions
These Terms & Conditions apply to all Users of InterWeb Connections hosting services, including, but not limited to, Domain, Web and Email hosting.
Any reference made to InterWeb Connections in this document shall be deemed to have been made to InterWeb Connections, its subsidiaries, assignees, affiliates and any company that controls InterWeb Connections.
Users agree that submissions and e-mail addresses may be used by InterWeb Connections for marketing its site(s) and/or services. If you do not want to receive email from InterWeb Connections please inform us.
Payment Policy
InterWeb Connections reserves the right to change the prices of products and/or services at any time. All pricing is guaranteed for the period of prepayment.
For Users opening their first web hosting account the initial 30 days are available on a trial basis. Optional extras are not included in the trial period. The User will not be entitled to this benefit if they have previously had an account with InterWeb Connections unless the period of absence has been greater than one year.
If the User wishes to cancel their web hosting account during the initial trial period they will be entitled to a refund, minus our normal price for a domain name purchased on its own. Any incentives offered to the User when opening the web hosting account will also be cancelled. The User may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation. Domain names will not be released or transferred until payment has been received and cleared, unless InterWeb Connections decides otherwise.
The User can pay by Credit Card - we accept the following currencies; Pounds Sterling (£), Euros (€), U.S. Dollars ($), Canadian Dollars (C $), and Yen (¥) through the PayPal system - or by Cheque in Pounds Sterling (£).
InterWeb Connections cannot guarantee that a service will be provided until after any received cheques have been cleared. No Invoices will be sent by regular mail. All Invoices will be sent directly to the User by email.
Recurring payments are due each anniversary year on the date the account was established. The User will automatically be charged again at the end of their prepay period unless closure notification has been received 30 days in advance of the renewal date.
InterWeb Connections reserves the right to suspend or cancel a Users access to any or all products and/or services provided by InterWeb Connections when InterWeb Connections decides that the account has been inappropriately used or otherwise. In this event the User will be entitled to a pro rata refund based upon the remaining period of membership. Fees charged for optional extras on a prepay basis are non-refundable. Fees charged for domain name registration are also non-refundable, and priced in accordance with our normal price for a domain name purchased on its own. If a User contravenes InterWeb Connections Terms & Conditions a refund will not be issued in the event of a cancellation.
The User may cancel their InterWeb Connections hosting account at any time. In this event the User will not be entitled to a refund. Cancellations must be in writing and sent to:

Unlimited Email Accounts
InterWeb Connections provides Users with the ability to create an unlimited number of email accounts (POP3 mailboxes, forwarders and responders). However, the fore mentioned accounts are not to be offered as a free email service, or resold to third parties in any way.
InterWeb Connections do not provide list server capability/services because of potential traffic and congestion problems that can be created on shared mail servers.
Disclaimer
Any use of InterWeb Connections hosting services is at your own risk. The products and services are provided 'as is'. InterWeb Connections disclaims any implied and express warranties, statutory or otherwise, guarantees and/or liabilities as to merchantability, fitness for a particular purpose, accuracy of content, non-infringement of proprietary rights, free from computer virus, condition, quality, security, durability, performance, un-interruption, non-deliveries and/or reliability of products and services to the fullest extent permitted by law.
Under no circumstances, including, but not limited to, negligence, shall InterWeb Connections and/or any subsidiaries be held liable for any direct, indirect, incidental, special or consequential damages, acts of nature, internet failures, computer equipment failures, telecommunications equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, explosions, war government actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, that result from the availability of, the use of, or the inability to use, InterWeb Connections hosting services, its materials, products and/or services.
You assume all responsibility and all risk for use of InterWeb Connections hosting services and will be solely responsible for any damage to your computer system or loss of data that results from downloading material.
InterWeb Connections shall have the right at any time to change, modify, discontinue, make additions or deletions to any aspect, service or feature of InterWeb Connections hosting services, including, but not limited to, content, hours of availability, and equipment needed for access or use.
Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your web space.
All rights not expressly granted herein are reserved.
Indemnification
By using InterWeb Connections hosting services you agree that you will defend, indemnify, save and hold InterWeb Connections, its parents, subsidiaries, affiliates, users and employees, harmless from any and all demands, liabilities, losses, costs and claims, expenses, including solicitor's fees asserted against InterWeb Connections, that may arise or result from any service provided or performed. User agrees to defend, indemnify and hold harmless InterWeb Connections against liabilities arising out of any material supplied by User infringing or allegedly infringing on the proprietary rights of a third party, including but not limited to, copyright and trademark infringement.
Legal Action
InterWeb Connections shall not be liable to any user for any loss of profits, loss of savings, loss of goodwill, loss of contracts, damages, including any incidental, special or consequential, loss, direct or indirect, deletion, inaccuracy, content, incompleteness, illegality, unreliability and non-availability, however incurred, arising out of the inability to use, the availability of, the reliance on, the improper use of, downloading information and material on, accessing information and material on, viruses or similar contamination, on InterWeb Connections server(s). In jurisdictions where the above clauses are excluded by law the clauses shall be read as being wholly severable from the remaining Terms & Conditions.
These Terms & Conditions of use and any subsequent legal proceedings relating to InterWeb Connections shall be governed by jurisdiction of InterWeb Connections headquarters and/or of InterWeb Connections choice. InterWeb Connections is operated from the United Kingdom and InterWeb Connections makes no representations that these products and/or service are appropriate to or available for use in other locations. If you use InterWeb Connections hosting services from other locations, you are responsible for compliance with the applicable local laws.
You acknowledge and agree that, subject to any statute or law to the contrary, any claim or cause of action you may have arising out of, or relating to, your use of the InterWeb Connections products and/or services or web site must be filed within 1 year after such claim or cause of action arises, or forever be barred.
These Terms & Conditions will be governed and interpreted pursuant to the laws of the United Kingdom. If any part of these Terms & Conditions is unlawful, void or unenforceable that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. InterWeb Connections failure to exercise any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision.
The User acknowledges that InterWeb Connections may be required by current or future law or regulation, including, but not limited to, the Regulatory of Investigatory Powers Act 2000, to access, monitor, store, take copies of, or otherwise deal with the Users data stored on or transmitted by the service. Without limitation, you expressly authorise us to use your personal data and other account information in connection with any such investigation, including by disclosing it to any third party authority that we consider has a legitimate interest in any such investigation or its outcome.
Users
You acknowledge that you are solely responsible for information, code, data, text, software, music, sound, pictures, photographs, graphics, video, chat, messages, files or other materials ("Content") you submit, upload, publish, e-mail, post or otherwise transmit (publicly or privately) and that you, not InterWeb Connections, have full responsibility for the content of Web pages owned and/or operated by you and/or messages, including their legality, reliability, appropriateness, originality and copyright. The User shall not place on InterWeb Connections server(s) any material which infringes upon or violates the right of others, is unlawful, threatening, defamatory, obscene, profane or otherwise objectionable, gives rise to civil liability or violates any law.
InterWeb Connections reserves the right to suspend, remove and/or delete any web page(s) on our servers at any time and for any reason. InterWeb Connections reserves the right to refuse service and/or access to our servers to anyone. InterWeb Connections reserves the right to delete any content on our server(s), with immediate effect, without warning and without further obligation or liability to the User.
InterWeb Connections do not allow any of the following content to be stored on our servers: illegal material - this includes; copyrighted works, commercial audio, video, music files, adult material, pornography, erotic images, lewd or obscene material, pirated software, and any material in violation of any Local, Federal, State or Country Laws and/or Regulations.
InterWeb Connections reserves the right to suspend a web site that exceeds it's allocated monthly bandwidth. In this event the User may be offered an option whereby InterWeb Connections continues to host the web site for an additional fee. This policy is intended to prevent the misuse of our servers.
Any violations of systems or network security are prohibited, and may result in the User facing criminal and civil liability. InterWeb Connections will investigate incidents involving such violations and will inform and co-operate with the relevant law enforcement organisations if a criminal violation is suspected. Violations may include, but are not limited to, unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network, unauthorised monitoring of data or traffic on any network or system without express authorisation of the owner of the system or network, or interfering with any User, host or network including mail-bombing, deliberate attempts to overload a system and broadcast attacks.
You may not store or distribute certain other types of prohibited material on our servers. Examples of prohibited material include, but are not limited to, programs containing viruses, Trojan horses and tools to compromise the security of other web sites.
Unsolicited advertising mailings, whether commercial or informational, are strictly prohibited. You may send advertising material only to addresses that have specifically requested it. InterWeb Connections will not forward mail of accounts terminated for bulk mailing or unsolicited advertising. Chain letters are unsolicited by definition and may not be propagated using our services.
The User may be required to register and provide certain data. In registering and providing such data you represent and warrant that the information about yourself is true, accurate, current, and complete (apart from optional items) and you will maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is inaccurate, not current, untrue or incomplete, or InterWeb Connections has reasonable grounds to suspect that such information is so, InterWeb Connections has the right to terminate your account and refuse any and all current or future use of InterWeb Connections products and/or services. After registering you will receive a password and user name. You are responsible for maintaining the confidentiality of the password and user name, and are fully responsible for all activities that occur under the password and/or user name. You agree to immediately notify InterWeb Connections of any unauthorised use of your password or account or any other breach of security and that InterWeb Connections will not be liable for any loss or damage arising from your failure to comply with this requirement. All InterWeb Connections registrations become the exclusive property of InterWeb Connections. InterWeb Connections reserves the right to use and reuse all registrations and other personally identifiable User information subject to InterWeb Connections Privacy Policy.
The User must be 18 years of age or older to subscribe to InterWeb Connections hosting services. In cases where the User has authorised a minor to use the products and/or services and/or access the User account, the User must recognise that they are fully responsible for the online conduct of such minor and the consequences of any misuse by the minor.
InterWeb Connections may at any time revise these Terms & Conditions by updating this posting/page. You are bound by any such revisions. You should thus periodically revisit this page to review the then current Terms & Conditions to which you are bound. Any use of InterWeb Connections hosting services shall be deemed to constitute acceptance of such revisions, charges, modifications or additions.

Miscellaneous
You acknowledge and agree that you and InterWeb Connections are independent contractors under these Terms & Conditions, and nothing herein shall be construed to create a partnership, joint venture, agency or employment relationship. Neither party pursuant to these Terms & Conditions has authority to enter into agreements of any kind on behalf of the other and neither party shall be considered the agent of the other.
